Town Board Meeting Minutes
August 1st, 2023
*6:00 p.m.*


1) Call to order. Town Supervisor, Curt Peterson called the meeting to order at 6:01 p.m.

Town Supervisors in attendance were David Pope, Pam Johnson-Loy, and Kyle Levetzow. Peter Vanderloo was absent. Also in attendance were Clerk/Treasurer Sara Olson, Randy Beerkircher, Kevin Zajicek and several members of the public. An attendance sheet of those individuals that signed-in is available.

Everyone in attendance recited the Pledge of Allegiance.

2) Approval of Public Notice/Agenda. Supervisor, Kyle Levetzow made a motion to approve the public notice and agenda seconded by Supervisor, David Pope. Motion carried.

3) Public Comment. Twenty-eight individuals provided public comment in regards to the proposed wind turbines in Iowa County as well as provided handouts of information. Numerous individuals indicated health and safety concerns, property value concerns, setback concerns, view concerns, concerns in regards to the PSC being broken and in violation of the 2009 Wisconsin Act 40 Law, concerns in regards to the administrative code being outdated, concerns in regards to notifications and the lack of being notified, concerns in regards to the size of the proposed turbines as well as the Wisconsin Towns Association’s legal opinion in regards to Wisconsin State Statue 66.0401. Several individuals provided information in regards to what their municipality’s are currently doing which included adopting moratoriums and creating committees to look into creating a Wind Licensing Ordinance. Several individuals requested the Town Board look into passing a Wind License Ordinance to protect the public’s health and safety.

Kyle Levetzow made a motion to suspend the agenda and move to Item #9. Pam Johnson-Loy seconded the motion. Motion carried.

4) Discussion & possible action re: WTA legal opinion in regards to Township Wind Siting Ordinance. Clerk/Treasurer Sara Olson presented the WTA’s legal opinion in regards to the regulations of Wind Turbines: Past and present from the May newsletter. This contained highlighted key points from an e-mail that was received from Scott Godfrey, Iowa County Planning and Development indicated his understanding that no town, village, city or county in Wisconsin can enact an ordinance regulating wind turbines that is more restrictive than the PSC 128 siting standards. The Town Board members discussed the May article. Kyle Levetzow indicated that he felt the opinion was leaving out the sentence in regards to health and safety and we need to keep looking into serving and protecting the public. Pam Johnson-Loy felt that a resolution could be drafted utilizing language that would satisfy the constituents until the PSC establishes standards. Pam Johnson-Loy encouraged all the individuals that were present to contact the legislators in regards to the PSC updating the administrative code. Curt Peterson had indicated that the Iowa County Corporate Council had the same legal opinion as the Wisconsin Towns Association and the Iowa County Zoning Committee didn’t take any action. He also indicated that it was unfortunate that the Town Government has to be involved and he wouldn’t support any ordinance or resolution due to the law. Kyle Levetzow indicated that he felt more time is needed to look into the law and to also allow the PSC to update the PSC 128 siting standards and felt a moratorium should be issued. The Town Board members requested that the creation of a resolution/moratorium on Development of Wind Energy Systems be placed on the September agenda for further discussion. No action was taken.

5) Discussion re: Wind Energy Facility Ordinance. Clerk/Treasurer Sara Olson presented a copy of a sample Wind Energy Facility Licensing Ordinance from the Town of Cassel, Marathon County. No action was taken.

6) Approval of Meeting Minutes from July 5th, 2023. Kyle Levetzow made a motion to approve the meeting minutes from July 5th, 2023 as presented. David Pope seconded the motion. Motion carried.

7) Approval of Treasurer’s Report for General, Sanitary District #1 and Tax Collection Account. Kyle Levetzow made a motion to approve the Town of Dodgeville’s July 2023 Treasurer’s Report stating the following fund balances:

General Checking $ 382,614.14
Farmer’s Savings $ 369,442.32
Local Government Investment Pool $ 7,709.73
Farmer’s Savings Tax Account $ 0.00
Intra-Fi CD’s $ 918,106.23

Township Funds: $1,677,872.42
Tax Funds: $ 0.00
ARPA Funds: $ 132,593.55

David Pope seconded the motion. Motion carried.

Kyle Levetzow made a motion to approve Sanitary District #1 Treasurer’s Report as submitted stating the following fund balances:

Sanitary District #1 $ 17,537.73

David Pope seconded the motion. Motion carried.

8) Bills to be approved. David Pope made a motion to approve the August 1st, 2023 vouchers in the amount of $190,382.35 and Sanitary District #1 vouchers in the amount of $4,252.34. Kyle Levetzow seconded the motion. Motion carried.

9) Town Roads/Equipment Report. The Town Patrolmen updated the Town Board in regards to equipment repairs that had been completed on the tandem trucks and showed the Town Board the new decals on the Town equipment.

10) Clerk/Treasurer Report. Clerk/Treasurer Sara Olson indicated that the office will be closed on Thursday, August 3rd and Friday, August 4th due to the Clerk/Treasurer will be on vacation.

11) Discussion & possible action re: Ordinance Chapter 33 Town of Dodgeville Room Tax. No action was taken as the Township is waiting for additional information.

12) Discussion & possible action re: Installation of Solar Panels at Town Hall. Town Chairman, Curt Peterson presented information in regards to having a solar site review/energy audit being completed for the Town Hall. David Pope made a motion to have Clerk/Treasurer Sara Olson contact 3 companies to begin a site review/energy audit. Kyle Levetzow seconded the motion. Motion carried.

13) Discussion & possible action re: Floyd Rd Update/Selection of Engineering Firm. Town Chairman, Curt Peterson updated the Town Board in regards to Floyd Rd and the submission of an application to the state to straighten out the intersection of State Road 130 and Floyd Rd. Kyle Levetzow made a motion to use Jewell & Associates for any engineering needs for this project. David Pope seconded the motion. Motion carried.

14) Discussion & possible action re: Update on Military Ridge Road. Clerk/Treasurer Sara Olson updated the Town Board in regards to the damages that were done in the ditches of Military Ridge Road due to the large rainfall that was received and the status of the repairs.

15) Adjournment. Kyle Levetzow made a motion to adjourn the meeting at 7:43 p.m. Pam Johnson-Loy seconded the motion. Motion carried.
