Plan Commission Meeting
Monday, January 28th, 2013
The Town of Dodgeville Plan Commission met on Monday, January 28th at 6:30 PM. Plan Commission Chairman Anthony Esch called the Planning Commission meeting to order at 6:30 P.M.
Plan Commission Committee members in attendance were: Robert Fitzsimmons, Katherine Cahill and David Blume. Absent were: Matthew Chitwood, Robert Butler and Curt Peterson.
Others in attendance were: Clerk/Treasurer Sara Olson, John Pipal, John Halverson, Josh Fowler, John Hassrick and Cindy Hassrick.
Chairman Anthony Esch verified that proper notice of the meeting was posted on January 21st, 2013 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. Robert Fitzsimmons made a motion to approve the public notice and agenda. Katherine Cahill seconded the motion. Motion carried.
David Blume made a motion to approve the November 26th, 2012 meeting minutes as submitted. Robert Fitzsimmons seconded the motion. Motion carried.
Chairman Anthony Esch asked Clerk/Treasurer Sara Olson to provide information to the Planning Commission on the rezoning application of 3.18 acres more or less from A-1 Ag to AR-1 located in part of the NE ¼ of the NE ¼ of Section 18, Township 6 North, Range 3 East located at 3893 Wilson Road. Sara Olson had indicated that they were looking to split off the home from the rest of the acreage. John Pipal who was representing the applicant verified the information that was provided by the Clerk/Treasurer. Katherine Cahill made a motion to recommend the approval of the rezoning of 3.18 acres more or less from A-1 Ag to AR-1 with the appropriate amount of land being placed into the conservancy district located in part of the NE ¼ of the NE ¼ of Section 18 Town 6 North Range 3 East located at 3893 Wilson Road currently owned by Brad Olson Estate. Robert Fitzsimmons seconded the motion. Motion carried.
Chairman Anthony Esch asked John Halverson who was representing the applicant to provide information to the Planning Commission on the rezoning application of 15.01 acres more or less from AR-1, A-1 and AB-1 to AR-1 located in part of the NE ¼ of the SE ¼ and the SE ¼ of the SE ¼ of Section 2 Town 6 North Range 3 East. John Halverson had indicated that they had changed their initial plans and are wanting to just rezone 15.01 acres that is currently zoned A-1 and AR-1 to just AR-1 increasing the existing lot size to 15 acres. The Plan Commission indicated that if they were not creating a separate parcel and only increasing the existing lot size no additional acreage would need to be put into conservancy for the density standard. Robert Fitzsimmons made a motion to recommend the approval of the rezoning of 15.01 acres more or less from AR-1 and A-1 to AR-1 to increase the existing lot size located in part of the NE ¼ of the SE ¼ and the SE ¼ of the SE ¼ of Section 25 Town 6 North Range 3 East located at 5392 Section Line Road in the Town of Dodgeville which is currently owned by George Lazarues. Kathi Cahill seconded the motion. Motion carried.
Chairman Anthony Esch asked Josh Fowler to provide information to the Plan Commission on the rezoning application of 5 acres more or less from AR-1 to B-3 Heavy Business located in the NE ¼ of the SW ¼ of Section 23 Town 6 North Range 3 East. Josh Fowler had indicated that he would like to construct an additional building to run a light manufacturing business and needs to rezone the property. Josh Fowler also indicated that he would like the following conditional uses: agricultural uses, a residence, light manufacturing of metal and rental storage space. The Plan Commission discussed the details in detail and asked several questions. David Blume made a motion to recommend the approval of the rezoning of 5 acres more or less from AR-1 to B-3 Heavy Business located in the NE ¼ of the SW ¼ of Section 23 Town 6 North Range 3 East located at 4949 County Road YZ in the Town of Dodgeville currently being owned by Joshua & Melissa Fowler. Katherine Cahill seconded the motion. Motion carried. David Blume made a motion to recommend the following conditional uses: agricultural uses, a residence, light manufacturing of metal and rental storage space with the following restrictions: lighting must be direct lighting, runoff must be container to the site, and dumpster (scrap piles) must be put in an enclosure or not visible from the street. Robert Fitzsimmons seconded the motion. Motion carried.
The Plan Commission didn’t discuss the Land Use Element-Survey.
John and Cindy Hassrick were present at the Plan Commission meeting and asked to discuss a potential rezoning. John & Cindy had indicated that they currently own a short forty that is currently zoned A-1 Legal Nonconforming and wanted to split off the house from the other land without having to put any land into conservancy. They purchased the property on January 5th, 2005 which was 5 days after the comprehensive plan was adopted to allow a one-time split for people who owned between 4 and 70 acres prior to January 1st, 2005. John & Cindy Hassrick indicated that if they knew about the Comprehensive Plan criteria they would have closed prior to the end of the year versus after the first of the year. Plan Commission member David Blume suggested that they provide a copy of their accepted offer to prove that they had a contract prior to January 1st, 2005. David Blume had indicated that he personally would be in favor of allowing the one time split if the proper documentation was given and filled with the Township but couldn’t speak for the entire Plan Commission. The rezoning was further discussed and it was indicated that both parcels would have to be rezoned AR-1 due to current county zoning or one lot would be AR-1 and the other would have to be C-1 Conservancy per county regulations.
David Blume made a motion to adjourn the meeting at 7:45 p.m. Katherine Cahill seconded the motion. Motion carried.
