Regular Town Board Meeting
January 6, 2009 @ 6:00 p.m.
1) Call to order. Town Chairman, Curt Peterson called the meeting to order at 6:02 p.m.
Town Supervisors in attendance were: Greg Jewell, David Gollon and Charles Price. Also in attendance were Clerk Sara Olson, Bob Butler, Debi Morton, Susan Van Sicklen and Michael Van Sicklen.
2) Approval of Public Notice/Agenda. Supervisor, David Gollon made a motion to approve the public notice and agenda seconded by Supervisor, Charles Price. Motion carried.
3) Approval of Meeting Minutes from December 1, 2008, December 2, 2008 and December 10, 2008. David Gollon made a motion to approve the December 1st 2008 Public Budget Hearing minutes, Notice of Special Town Meeting of the Electors of the Town of Dodgeville minutes, and the Special Town Board Meeting minutes as presented. Greg Jewell seconded the motion. Motion carried. Charles Price abstained from the motion as he wasn’t in attendance at these meetings. Charles Price made a motion to approve the December 2, 2008 meeting minutes with the following correction in Paragraph 10. Insert the following sentence to the end of the paragraph, David Thomas seconded the motion. Motion carried. Greg Jewell made a motion to approve the December 10, 2008 as presented. Charles Price seconded the motion. Motion carried.
4) Approval of Treasurer’s Report for General, Sanitary District #1, 2, 3 and Tax Collection Account. Charles Price made a motion to approve the Town of Dodgeville December 2008 Treasurer’s Report as submitted stating the following fund balances:
General Checking $ 37,748.28
Farmer’s Savings $ 84,913.72
Wells Fargo Tax Account $ 1,371,741.94
Local Government Investment Pool $ 6,888.77
Greg Jewell seconded the motion. Motion carried.
Greg Jewell made a motion to approve Sanitary Districts #1, 2, 3 Treasurer’s Report and Tax Collection Account as submitted stating the following fund balances:
Sanitary District #1 $ 11,987.64
Sanitary District #2 $ 4,014.88
Sanitary District #3 $ 320.83
David Gollon seconded the motion. Motion carried.
Curt Peterson made a motion to suspend the agenda. Greg Jewell seconded the motion. Motion carried.
5) Bills to be approved. Greg Jewell made a motion to approve the January vouchers in the amount of $85,321.14. The Town Board will be only paying $50,000.00 to Tri-State Truck Equipment versus the submitted bill in the amount of $53,626.00. The remainder of this bill will be paid next month contingent that the new snow plow is fully functioning and complete. David Gollon seconded the motion. Motion carried.
6) Discussion and possible action re: Final Road Acceptance for 2nd Northridge Addition, Penny Lane. David Gollon made a motion to place this agenda item on the Town Board Meeting agenda for February 3, 2009 due to the necessary paperwork has not yet been completed by Bruce Bowden. Charles Price seconded the motion. Motion carried.
7) Discussion and possible action re: Audit Review. The Town Board was presented with information from Johnson & Block in reference to the 2007 audit and areas that were in need of improvement. The Town Board discussed each element individually. The Town Board determined that many of the areas that needed improvement have been due to the change over in staff. The current Clerk/Treasurer is working on improving these areas for the 2008 audit. No action was taken.
8) Discussion and possible action re: 2008 Budget Reconciliation. Charles Price made a motion to transfer $63,474.44 from Intergovernmental Revenue to Capital Outlay pending the decision of Johnson & Block and how to correctly account for the snowplow loan we received to pay for the Capital Outlay expense. Greg Jewell seconded the motion. Motion carried.
9) Discussion and possible action re: Iowa County Humane Society 2009 Animal Impound Agreement. David Gollon made a motion to pay the Iowa County Humane Society a fee of $3,000.00 to impound the stray or abandoned animals for the Town of Dodgeville from January 1, 2009 through December 31, 2009. The Town Board is requesting the Township be provided copies of the adoption policy, procedures for stray or abandoned animals and an explanation of the reports that were presented from Iowa County Humane Society prior to paying the 2009 Animal Impound Agreement. Greg Jewell seconded the motion. Motion carried.
10) Discussion & possible action re: Wells Fargo Membership Program. Craig Mayo from Wells Fargo gave information to Clerk Sara Olson to present to the Town Board in reference to the Wells Fargo Membership Program that they current offer to their customers. This program would allow the Employees of the Town of Dodgeville to qualify for a bundle of account and service offers. David Gollon made a motion to decline the Wells Fargo Membership Program at this time. Greg Jewell seconded the motion. Motion carried.
11) Discussion & possible action re: Delinquent Utility Disconnection Notice. Clerk Sara Olson presented the Town Board with a Delinquent Utility Disconnection Notice to be issued to Sanitary District User’s with a delinquent account balance. The Town Board reviewed the document and requested that Clerk Sara Olson verify information with the City of Dodgeville in reference to their current procedures for delinquent utility accounts. The Town Board also requested Clerk Sara Olson to revise the disconnection notice and present it at the next Town Board meeting for approval. No action taken.
12) Discussion & possible action re: Revision of Section 4: Benefits and Employee Pay Subsection 4.12: Insurance Plan Policy in the Employee Handbook: The Town Board was presented with a rough draft of the Health Insurance Compensation or Reimbursement policy and the Waiver of Reimbursement created by Clerk Sara Olson and Brent Straka from Tricor Insurance. David Gollon made a motion to contact the town’s attorney Allan Peckham to draft the Health Insurance Compensation or Reimbursement Policy to verify the legality and wording of the policy with the assistance of Town Chairman, Curt Peterson. Greg Jewell seconded the motion. Motion carried.
13) Discussion & possible action re: Holiday Pay for Part-time Employees. Clerk Sara Olson requested the Town Board to verify if Part-time employees are eligible for Holiday Pay. Per the Town of Dodgeville Employment Manual a regular part-time employee is entitled to 50% of the benefits indicated in the handbook. A Regular Part-time employee is an employee who works an average of more than 20 hours but less than 40 hours per week. No action taken.
14) Discussion & possible action re: Attorney’s Opinion. Clerk Sara Olson presented the Town Board with a letter from Dewitt, Ross & Stevens in reference to two questions that were asked by the Town Board in reference to the Iowa County Board. The two questions were as follows: Can the Iowa County Board deny zoning petition requests without giving specific reasons? If the zoning request meets the requirements of the Town of Dodgeville’s Comprehensive Plan can the Iowa County Board deny the request with no specific reference to the Plan? This document may be viewed at the town hall located at 108 E. Leffler Street in Dodgeville. The Town Board emphasized that they feel if the county is going to deny a petition they should give reason as to the Comprehensive Plan so that the Town Planning Commission and Town Board can be educated on how it possibly didn’t comply with the plan. No action taken. Clerk Sara Olson also presented the Town Board with the opinion of the township’s attorney in reference to getting a deed restriction recorded from 2002. The Town Board has requested that Clerk Sara Olson contact the Iowa County Planning & Zoning office to clarify the motion that was made in 2002 in reference to the particular zoning petition to determine if anything can be done at the county level before proceeding with the town’s attorney.
15) Public Comment.
Mike Van Sicklen talked to the Town Board in reference to the legal opinion they received from Dewitt, Ross & Stevens. Mike Van Sicklen stated that he agrees with the legal opinion the town received, however he feels as if there are a lot of emotions in reference to the current situation. He also stated that there are a lot of differences in opinions with the plan and the plan is only a guide.
Bob Butler stated that irregardless of the outcome of the situation we asked great questions that needed to be answered and it has motivated the town members to become involved.
16) Adjournment. Charlie Price made a motion to adjourn the meeting at 9:22 p.m. Greg Jewell seconded the motion. Motion carried.
