BOARD OF REVIEW MEETING MINUTES
TOWN OF DODGEVILLE
July 22, 2010
Board of Review was called to order at 6:30 p.m. by Town Chairman, Curt Peterson.
Members present were: Curt Peterson, David Gollon, Thomas Mueller, Charlie Price, Assessor representative, Lucas Cummings, Assessor Calvin Magnan, Tony Berg, Susan Ketchum, Glen Hanson, Daryl Trumpy, Karen Trumpy and Clerk, Sara Olson. Absent was: David Thomas.
Thomas Mueller made a motion to accept the June 1st, 2010 meeting minutes as presented. David Gollon seconded the motion. Motion carried.
Thomas Mueller made a motion to nominate Curt Peterson to serve as Chairperson for this BOR. David Gollon seconded the motion. Roll call: Price, yes; Mueller, yes; Gollon, yes; and Peterson, abstained. Motion carried.
David Gollon made a motion to nominate Charlie Price to serve as Vice-Chair for this BOR. Thomas Mueller seconded the motion. Roll call: Price, abstained; Mueller, yes; Gollon, yes; and Peterson, yes. Motion carried.
Clerk Olson verified that the 2010 Assessment Roll was received and that she witnessed Calvin Magnan signing the assessor?s affidavit.
Clerk Olson verified that proper notice of the BOR was posted on June 30, 2010 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. In addition notice was also published in the Dodgeville Chronicle on July 1st, 2010. Clerk Olson also verified that Charles Price and Curt Peterson satisfied the training requirements for BOR.
Charlie Price moved that this Board of Review is in compliance with the open meeting law. Thomas Mueller seconded the motion. Roll call: Price, yes; Mueller, yes; Gollon, yes; and Peterson, yes. Motion carried.
Hearing of Objections:
A. Parcel #008-0057.A, 5568 County Road ZZ, owner Susan Ketchum. 0.25 acres, land $8,000, improvements $26,400 for a total of $34,400.
1. Clerk to swear in Petitioner(s) and assessor: The Clerk swore in Susan Ketchum and Calvin Magnan.
2. Testimony:
a) Petitioner: Susan Ketchum stated that the taxable value of the property should be $10,000.00 as stated on the objection form. She distributed a list of comparable sales that she compiled which sold for $10,000 - $18,000.00. She indicated that she received a market analysis but was unable to supply a copy. Ketchum explained the comparables in detail and made mention that this lot should be based on non-conforming use restrictions, a substandard size lot, set-backs and the condition of the home.
3. Clerk to swear in Witness: The Clerk swore in Glen Hanson.
4. Testimony:
a) Witness: Glen Hanson presented statistics of the history of this home and noted back in the 1980?s it was estimated at $15,000 to fix the home.
b) Assessor: Calvin Magnan presented 1 comparable sale that was located within the Town of Dodgeville at 4955 County Road ZZ which sold for $75,000.00. Calving Magnan indicated that he has the shed at $10.00 per square foot.
5. Deliberations/Determination: There was a review by the board of the current condition of the building as well as the restrictions due to the lot size and setbacks. Motion by Charlie Price that the assessor?s valuation is incorrect, and the valuation should be land $8,000, improvement $22,000 totaling $30,000.00 due to the conditions of the residential structure. Motion seconded by Mueller. Motion carried 4-0 by roll call vote.
6. Provide Petitioner of Notice of Determination: The clerk provided notice to Susan Ketchum of Board of Review Determination of $8,000 land, $22,000 improvements for a total assessed value of $30,000.
B. Parcels 0081245.18, 1405-1407 Bea Ann Drive, owner Anthony Berg, 0.33 all classified as residential, land $32,000, improvements $133,500 for a total of $165,500.
1. Clerk to swear in Petitioner and Assessor: The Clerk swore in Anthony Berg and Calvin Magnan.
2. Testimony:
a) Petitioner: Berg stated that he felt the taxable value of the property was $119,600. Anthony Berg brought in three comparable sales and discussed them in detail and felt his duplex best compared to 304-306 Spring Street.
b) Assessor: Calvin Magnan indicated that he had already made an adjustment at open book decreasing the value of the property by $58,900 due to the same comparable sale that was presented at open book by him and a different owner of a duplex on Bea Ann Drive. Calvin Magnan also presented information in reference to two comparable sales in 2009.
3. Deliberations/Determination: There was a review by the board of the comparable sales provided by the petitioner. Motion by Charlie Price that the assessor?s valuation is correct at $165,500. Motion seconded by David Gollon. Motion carried 4-0 by roll call vote.
4. Provide Petitoner of Notice of Determination: The clerk provided.
C. Parcels 0081245.50, 1397-1399 Bea Ann Drive, owner Anthony Berg, 0.33 all classified as residential, land $32,000, improvements $141,400 for a total of $173,400.
1. Clerk to swear in Petitioner and Assessor: The Clerk swore in Anthony Berg and Calvin Magnan.
2. Testimony:
a) Petitioner: Berg stated that he felt the taxable value of the property was $123,600. Anthony Berg brought in three comparable sales and discussed them in detail and felt this duplex best compared to 304-306 Spring Street.
b) Assessor: Calvin Magnan indicated that he had already made an adjustment at open book decreasing the value of the property by $77,900 due to the same comparable sale that was presented at open book. Calvin Magnan also presented information in reference to two comparable sales in 2009.
3. Deliberations/Determination: There was a review by the board of the comparables provided by the petitioner. Motion by Charlie Price that the assessor?s valuation is correct at $173,400. Motion seconded by David Gollon. Motion carried 4-0 by roll call vote.
4. Provide Petitioner of Notice of Determination: The clerk provided.
D. Thomas Mueller made a motion to adjourn the 2010 Board of Review meeting at 8:30 p.m., seconded by David Gollon. Roll call: Price, yes; Gollon, yes; Mueller, yes; and Peterson, yes. Motion carried.
