Regular Town Board Meeting
July 7, 2009 @ 6:00 p.m.

1) Call to order. Town Chairman, Curt Peterson called the meeting to order at 6:03 p.m.

Town Supervisors in attendance were: Thomas Mueller, David Gollon, and David Thomas. Also in attendance were Clerk Sara Olson and Chess Adams. Absent Town Supervisor: Charlie Price.

2) Approval of Public Notice/Agenda. Supervisor, Thomas Mueller made a motion to approve the public notice and agenda seconded by Supervisor, David Gollon. Motion carried.

3) Approval of Meeting Minutes from June 2nd, June 4th Board of Review & June 4th Special Meeting. Thomas Mueller made a motion to approve the June 2nd minutes as presented. David Gollon seconded the motion. Motion carried. The Town Board has requested that Clerk/Treasurer Sara Olson contact the Wisconsin Towns Association in reference to the procedure for approving the June 4th Board of Review minutes. David Thomas made a motion to approve the June 4th Special Meeting minutes as presented. David Gollon seconded the motion. Motion carried. Thomas Mueller abstained.

Thomas Mueller made a motion to suspend the agenda to Item #7. David Thomas seconded the motion. Motion carried.

4) Discussion & possible action re: Driveway Variance for Chess Adams on James Road. Chess Adams presented information to the Town Board in reference to his request to obtain a driveway variance from the Town of Dodgeville due to constructing a driveway according to the Ordinance would cause a hardship. Chess Adams would like to construct a 17X25 foot cabin on his property on James Road to be used for recreation purposes only. This cabin will have no electric or septic and will have a privy. The Town Board has requested that Chess Adams draft a Driveway Variance Agreement and bring it back to the Town Board for approval. The Town Board indicated that the agreement would need to contain the following with possible additions after the Clerk/Treasurer contacts the county and emergency officials: This cabin is to be used for recreational purposes only and can’t become a permanent residence without the installation of a driveway according to the Driveway Ordinance. Any improvements made to this structure such as electrical or a septic system will require a driveway to be installed according to the Driveway ordinance. The property owner is also responsible for purchasing an address sign to be placed at the entrance of the existing driveway on James Road that allows them to travel to the structure. No action taken.

5) Approval of Treasurer’s Report for General, Sanitary District #1, 2, 3 and Tax Collection Account. Thomas Mueller made a motion to accept the Town of Dodgeville June 2009 Treasurer’s Report as submitted stating the following fund balances:

General Checking $ 12,617.75
Farmer’s Savings $ 20,463.16
M&I Bank Tax Account $ 65,944.11
Local Government Investment Pool $ 6,917.79
M&I Bank CD’s $ 150,000.00

David Gollon seconded the motion. Motion carried.

Thomas Mueller made a motion to approve Sanitary Districts #1, 2, 3 Treasurer’s Report and Tax Collection Account as submitted stating the following fund balances:

Sanitary District #1 $ 13,072.59
Sanitary District #2 $ 7,725.35
Sanitary District #3 $ 145.91

David Gollon seconded the motion. Motion carried.

6) Bills to be approved. David Gollon made a motion to approve the July vouchers in the amount of $143,468.69. Thomas Mueller seconded the motion. Motion carried. *Note there was a cell formula error on the spreadsheet that was presented to the Town Board, therefore the total of all bills submitted for approve on July 7th was $143,468.69 not $138,046.72.*

7) Discussion & possible action re: Plan Commission Recommendations. David Gollon made a motion to recommend the approval of the rezoning of the 2 acres more or less which contains the existing trailer from A-1 Ag to AR-1 Ag residential being in part of the SE/SE of S19-T6N-R3E with the conditions that a 66’ easement is described on the Certified Survey Map, a shared driveway agreement is signed and recorded at the Register of Deeds and the remaining acreage be put into the conservancy district or overlay district. David Thomas seconded the motion. Motion carried. Thomas Mueller abstained from this motion.

The Town Board took no action on the petition by Morton Buildings due to they were zoned to B-H General Highway Business District upon the recording of the Corporate Boundary Agreement, therefore there was no need for rezoning.

8) Town Roads Report. Town Chairman, Curt Peterson talked to the Board about the road work that has been completed this year as well as when we anticipate Fahrner’s to complete the seal coating projects this year. No action taken.

9) Equipment Repairs Report. Clerk/Treasurer Sara Olson talked to the Board about the Town’s mower tractor and Grader that had been repaired. No action taken.

10) Approval or Denial of Operator’s License for Carol Wood, Betty Smith & David Raess. Thomas Mueller made a motion to approve an Operator’s License for Carol Wood, Betty Smith & David Raess with the verification of a satisfactory background check. David Thomas seconded the motion. Motion carried.

11) Approval or Denial of a Temporary Class “B” Retailer’s License for Pleasant Ridge Store – Ridge Festival. David Gollon made a motion to approve a Temporary Class “B” Retailer’s License for Pleasant Ridge Store for the Ridge Festival that will be held on August 1, 2009 through August 2, 2009. Thomas Mueller seconded the motion. Motion carried.

12) Discussion & possible action re: Recommendation to the Department of Transportation on the County Y Interchange options. David Gollon made a motion to recommend the following rankings to the Department of Transportation on the County Y Interchange options: Alternative 1B (First), Alternative 1A (Second), Alternative 1C (Third), Alternative 1D (Absolutely Not). The Town of Dodgeville also strongly recommends with all alternatives that County Y and County YZ become Highway 191 and have the North frontage road be connected to the Town of Ridgeway due to potential liabilities to the Town and emergency service vehicles. Thomas Mueller seconded the motion. Motion carried.

13) Discussion & possible action re: Water & Sewer Meter Issues and Maintenance in the Sanitary Districts. This item will be postponed until further notice due to the Town Clerk/Treasurer is still obtaining copies of agreements that we have with the city. No action taken.

14) Discussion & possible adoption re: Resolution 2009-264 Town of Dodgeville Fee Schedule. Thomas Mueller made a motion to adopt & approve Resolution 2009-264 Town of Dodgeville Fee Schedule. David Gollon seconded the motion. Motion carried. A copy of this Resolution is located on the Town of Dodgeville website as well as the Town Hall located at 108 E. Leffler Street, Dodgeville WI.

15) Discussion & possible adoption re: Town of Dodgeville Code of Ordinance Chapter 1 thru 23 Amendment. David Gollon made a motion to approve & adopt the Town of Dodgeville Code of Ordinance Chapter 1 thru 23 Amendment. Thomas Mueller seconded the motion. Motion carried. The Amendment will be available for review at the Town Hall or on the Town of Dodgeville Website at www.townofdodgeville.com.

16) Closed Session in Accordance with Wisconsin Statue 19.85 (1) (c) to consider employment, promotion, employee hours, compensation or performance evaluation of any public employee of which the governmental body has jurisdiction or exercises responsibility. David Thomas seconded the motion. Roll call: Thomas, yes, Peterson, yes, and Mueller, yes, and Gollon, yes. Motion carried. Also present was Clerk/Treasurer Sara Olson.

16) Reconvene into Open Session. Thomas Mueller made a motion to reconvene into open session at 8:29 p.m. David Thomas seconded the motion. Motion carried.

17) Board Action as a Result of Closed Session. David Thomas made a motion to approve the amended Recycling Center Attendant Job Description modifying the Item #1 Recycling Center Hours to state the following: The Town of Dodgeville Recycling Center will be opened and staffed by the recycling center attendant on Wednesday’s from 3:00 p.m. to 6:00 p.m. and Saturday’s from 8:00 a.m. to 2:00 p.m., effective September 1, 2009. If normal Recycling Center hours fall on a holiday the board or its designee may determine a different day to hold Recycling Center hours if necessary. The attendant(s) of the Recycling Center may be allowed to enter the premises up to 30 minutes prior to the opening or closing of the Recycling Center to prep the facility. This may include snow removal, cleaning and securing of the facility. This time will be considered time worked and duties and the time allowed will be at the discretion of the Board. Thomas Mueller seconded the motion. Motion carried. David Thomas made a motion to provide the current employee with a copy of the Employee Manual and the Recycling Center Attendant Job Description. The document verifying that the employee read, understood and agrees to comply with these documents is to be signed and returned to the Clerk/Treasurer by August 1st, 2009 and will take effect on September 1, 2009. If this document is not received by August 1st, 2009 this position will be posted. Thomas Mueller seconded the motion. The motion was carried. David Gollon made a motion to have all cats removed from the Recycling Center premises and no feeding, enticing or encouraging of animals will be allowed or accepted immediately due to public safety issues. David Thomas seconded the motion. The motion was carried.

18) Public Comment. None

19) Adjournment. Thomas Mueller made a motion to adjourn the meeting at 8:45 p.m. David Gollon seconded the motion. Motion carried.
