Plan Commission Meeting Minutes
Monday, November 24th, 2008

The Town of Dodgeville Plan Commission met on Monday, November 24, 2008 at 6:30 PM. Chair, Dave Blume called the meeting to order at 6:31 PM.

Plan Commission Committee members in attendance were: Chair, Dave Blume, Laura Jean Blotz, Curt Peterson, Matt Chitwood, John Crook, Greg Jewell and Larry Lenox.

Others in attendance were: Clerk/Treasurer Sara Olson, Bob Butler, Dee Slaght, Roger Stewart, Linda Berg, Larry Berg, Tom Mathews and Charles Price.

Chairman Blume verified that proper notice of the meeting was posted on November 19, 2008 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. All adjoining property owners were also sent notice on November 12, 2008. Laura Jean Blotz made a motion to approve the public notice and agenda. Matt Chitwood seconded the motion. Motion carried.

Curt Peterson made a motion to approve the October 27, 2008 meeting minutes as submitted. Matt Chitwood seconded the motion. Motion carried.

Chairman Blume asked Dee Slaght who was representing herself in the current petition to explain the current petition. Dee Slaght indicated to the Plan Commission that she was trying to divide off a 1 acre parcel with the house leaving 10 acres plus or minus as a separate parcel. The petition was to divide off a 1 acre parcel with the house leaving 10 acres plus or minus as a separate parcel being in part of the SW/NW of S21-T6N-R3E in the Town of Dodgeville and also to remove a deed restriction that restricts division of lots to three acres. Dee Slaght also indicated to the Town Board that she had obtained a driveway permit for the city as previously requested however we had only received a signed Driveway Application.

The Plan Commission members discussed the current deed restriction that was to be recorded in 2002 and has not yet been filed with the Register of Deeds by the Slaght’s. The deed restriction that was to be filed limits future divisions to a minimum of 3 acres and only single or 2 – family residences. The current ordinance allows lot sizes to a minimum of 2 acres. Many of the Board members felt lifting the deed restriction would create a negative impact in the township among others whom may have deed restrictions and the committee would be setting a negative precedence on the security of a deed restriction.

Chairman Blume opened the floor for public comment.

Tom Mathews – Tom Mathews stated that he owns the bottom 3 acres that is connected to Dee and Roger Slaght’s property and feels as if the Plan Commission members should respect the 3 acre minimum due to less acreage is not appropriate for the neighborhood. He also feels if it is changed to 1 acre that there will be the ability for people to make one home at a time and potentially create a subdivision because what is fair for one is fair for another.

Bob Butler – Bob Butler stated that he felt if they lifted and changed the current deed restriction that the Plan Commission would be going down a slippery path due to the negative arguments from the public are clear and severe that they don’t support this petition. He also felt that the Plan Commission would be setting a precedence for anyone else that had a few acres and would potentially be able to split them off into lower acre lots to build homes.

John Crook made a motion that would allow a 2 acre lot and the remaining acreage would be re-zoned to AR-1. This would require removing of the deed restriction that was never recorded with the Register of Deeds by getting a Resolution recorded and adopted by the Town Board as well as obtaining the original copy from the Slaught’s that would be placed in there folder at the Township. A new Deed Restriction would have to be drafted changing the minimal lot size to 2 acres. No one seconded the motion, therefore the motion died. No action taken.

Larry Lenox made a motion that it currently stands at a 3 acre lot and the deed restriction be filed with the Register of Deeds. At this point Dee Slaght verbally withdrew her request during this motion and left the building. No action was taken.

John Crook made a motion to make a recommendation to the Town Board to contact the Townships attorney to get an opinion about what action can be taken to get the Deed Restriction from 2002 recorded. If the opinion is that we can pursue something to get it filed the Plan Commission is recommending the action be taken. Matthew Chitwood seconded the motion. Motion carried.

John Crook made a motion to adjourn the meeting at 7:18 p.m. Greg Jewell seconded the motion. Motion carried.
