Plan Commission Meeting
Monday, November 26th, 2012
The Town of Dodgeville Plan Commission met on Monday, October 29th at 6:30 PM. Plan Commission Chairman Anthony Esch called the Planning Commission meeting to order at 6:30 PM.
Plan Commission Committee members in attendance were: Robert Fitzsimmons, Katherine Cahill, Curt Peterson, David Blume and Robert Butler. Absent was: Matthew Chitwood.
Others in attendance were: Clerk/Treasurer Sara Olson and Brad Parkin.
Chairman Anthony Esch verified that proper notice of the meeting was posted on November 21st, 2012 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. Katherine Cahill made a motion to approve the public notice and agenda. Robert Fitzsimmons seconded the motion. Motion carried.
David Blume made a motion to approve the October 29th, 2012 meeting minutes as submitted. Robert Fitzsimmons seconded the motion. Motion carried.
Chairman Anthony Esch asked Brad Parkin to provide any additional information to the Planning Commission on the conditional use application to divide an existing 11.60 acre AR-1 lot into two AR-1 lots in the S ½ of the SE ¼ of Section 20 and the N ½ of the NE ¼ of Section 29, Township 6 North, Range 4 East located at 3269 Evans Quarry Road. Brad Parkin had indicated that he is renting out his shed as a residence and was notified by the county that he needed to obtain a conditional use permit. Brad Parkin had also indicated that he never thought the residence would be a permanent thing until his income declined. Brad Parkin also stated that he has been renting out the premises for approximately five years and knew he needed to obtain permits for everything he does in the construction business however he never obtained a permit for changing the shed into a residence. David Blume & Curt Peterson explained to Brad how there are many ordinances in place that need to be followed at the town and county level. They indicated that they have a hard time when individuals come in to ask for forgiveness after the fact versus following the correct procedure that others have to follow when they are well aware of what the correct procedure is in the Town of Dodgeville. David Blume gave an example of a similar situation that happened in the Township and indicated that this is a precedence setting situation. Robert Butler, Robert Fitzsimmons, Katherine Cahill and Anthony Esch indicated that they feel the same way when it comes to ordinances and following the rules however they felt this should be about the zoning and not the moral of the situation or violations. These members indicated that this property is eligible for a one-time split as indicated in the plan and there isn’t anything in the plan that talks about what the consequences are when someone violates ordinances. Plan Commission member Curt Peterson referenced Section I – Implementation Plan (Plan Enforcement). The Plan Commission members did indicate that they need to look into possibly revising the plan to put a fee or something into place when individuals violate the ordinances that are currently in place.
Katherine Cahill made a motion to recommend the approval of the conditional use application to divide an existing 11.60 acre AR-1 lot into two AR-1 lots in the S ½ of the SE ¼ of Section 20 and the N ½ of the NE ¼ of Section 29, Township 6 North, Range 4 East located at 3269 Evans Quarry Road with the conditions that all necessary approvals are received such as: verifying and inspecting the structure to verify that it meets the Uniform Dwelling Code, either installing a separate septic system for the shed/residence or enlarging the existing system to accommodate both residential structures, taking care of any driveway easements and maintenance agreements and obtaining a zoning permit from the county. Robert Fitzsimmons seconded the motion. Motion carried. Curt Peterson and David Blume were opposed. David Blume stated he voted no on the basis of precedence setting.
The Plan Commission talked about the previous Smart Growth Survey results that were distributed by the Clerk/Treasurer. The Plan Commission indicated that they are still trying to brainstorm for questions and ideas for the survey.
Katherine Cahill made a motion to adjourn the meeting at 8:01 p.m. Robert Fitzsimmons seconded the motion. Motion carried.
