Town Board Meeting Minutes
October 3rd, 2023

1) Call to order. Town Supervisor, Curt Peterson called the meeting to order at 6:01 p.m.

Town Supervisors in attendance were Peter Vanderloo, David Pope, and Kyle Levetzow. Pam Johnson-Loy was absent. Also in attendance were Clerk/Treasurer Sara Olson, Randy Beerkircher, Kevin Zajicek and approximately 17 members of the public.

Everyone in attendance recited the Pledge of Allegiance.

2) Approval of Public Notice/Agenda. Supervisor, Kyle Levetzow made a motion to approve the public notice and agenda seconded by Supervisor, David Pope. Motion carried.

3) Public Comment. Several individuals provided public comments in regards to the creation of a Resolution/Moratorium on Development of Wind Energy Systems as well as provided handouts of information. The individuals indicated they felt a moratorium and licensing ordinance could be developed and should be adopted protecting the public’s health and safety as well as indicated health and safety concerns, setback concerns, concerns in regards to the application/updated map that has been submitted by Pattern Energy, concerns in regards to the number of proposed turbines and concerns in regards to the size of the proposed turbines.

4) Discussion & possible action re: Creation of Resolution/Moratorium on Development of Wind Energy Systems. Clerk/Treasurer Sara Olson presented a copy of a moratorium that was received from the Town of Waldwick. The Town Board members discussed the creation of a Resolution/Moratorium on Development of Wind Energy Systems. Kyle Levetzow indicated that his goal is to create a moratorium that would allow time for the PSC and Wind Sitting Council to update the administrative code and not get to the development of a Licensing Ordinance. Curt Peterson presented three handouts in regards to Wind Turbines. Curt Peterson indicated he would support a resolution to the legislators and the governor asking them to adopt a moratorium. Peter Vanderloo indicated that he had contacted four different attorney’s and received no encouragement to adopt an Ordinance or moratorium as well as referenced the WTA legal opinion and Iowa County’s Corporate Council. Peter Vanderloo indicated that its his opinion that the Township has no legal stand to adopt an Ordinance or Moratorium as the legislators have removed the Towns authority. Kyle Levetzow made a motion to establish a Wind Turbine Moratorium that states our goal is to be able to review the updated recommendations of the Wind Siting Council once they submit the legally required report to the legislator. The moratorium would expire 90-days after the wind sitting council completes their work. An attorney would help draft the proposed moratorium. Peter Vanderloo seconded the motion. Motion failed (2-2). David Pope and Curt Peterson were opposed.

5) Approval of Meeting Minutes from September 5th, 2023 and September 18th, 2023. Kyle Levetzow made a motion to approve the meeting minutes from September 5th, 2023 and September 18th, 2023 as presented. Peter Vanderloo seconded the motion. Motion carried.

Kyle Levetzow made a motion to suspend the agenda and move to Item #12 Discussion & possible action re: Update on Room Tax Ordinance. David Pope seconded the motion. Motion carried.

6) Discussion & possible action re: Ordinance Chapter 33 Town of Dodgeville Room Tax. Jenna Vondra and Curt Peterson updated the Town Board in regards to meeting with the city in regards to the creation of a joint tourism commission. Clerk/Treasurer Sara Olson indicated that the City Clerk was in contact with the city attorney in regards to updating/modifying the room tax ordinance. The Town Board indicated that the Town and City would be working together in regards to creating a joint tourism commission and this agenda item will appear on a future agenda.

7) Approval of Treasurer’s Report for General, Sanitary District #1 and Tax Collection Account. David Pope made a motion to approve the Town of Dodgeville’s September 2023 Treasurer’s Report stating the following fund balances:

General Checking $ 78,522.61
Farmer’s Savings $ 74,895.19
Local Government Investment Pool $ 7,778.41
Farmer’s Savings Tax Account $ 0.00
Intra-Fi CD’s $ 823,457.17

Township Funds: $ 984,653.38
Tax Funds: $ 0.00
ARPA Funds: $ 130,407.84

Kyle Levetzow seconded the motion. Motion carried.

David Pope made a motion to approve Sanitary District #1 Treasurer’s Report as submitted stating the following fund balances:

Sanitary District #1 $ 16,636.58

Kyle Levetzow seconded the motion. Motion carried.

8) Bills to be approved. Kyle Levetzow made a motion to approve the October 3rd, 2023 vouchers in the amount of $38,944.07 and Sanitary District #1 vouchers in the amount of $4,496.07. David Pope seconded the motion. Motion carried.

9) Town Roads/Equipment Report. The Town Patrolmen presented information in regards to the costs of sanding materials, the wedging that was completed by the county, equipment updates and discussed the front tires on the F550. Town Chairman, Curt Peterson updated the Town Board in regards to new driveways within the Township.

10) Clerk/Treasurer Report. Clerk/Treasurer Sara Olson reminded the Town Board of the Fall Clean-Up that is being held on Saturday, October 7th and indicated that the DNR has reinstated burning permits due to the dry conditions.

11) Discussion & possible action re: Military Ridge Pay Request #2 and Updates. Clerk/Treasurer Sara Olson updated the Town Board in regards to the work that was still needing to be completed by Pustina Excavating and presented pay request #2. David Pope made a motion to approve and pay the pay request in the amount of $25,589.99 contingent upon Pustina Excavating completing the work. Kyle Levetzow seconded the motion. Motion carried.

12) Discussion & possible action re: Update on Mower Tractor & Equipment. Clerk/Treasurer Sara Olson presented the approval letter from the PSC in regards to utilizing the one-time environmental impact fee, the letter requesting the change in dollar amount as well as the information that was received from Adam Ingwell in regards to the letter requesting the change in the dollar amount. The PSC indicated that they approve the use of the environmental impact fee not the specific dollar amount.

13) Discussion & possible action re: Update on Installation of Solar Panels at Town Hall. Clerk/Treasurer Sara Olson presented information in regards to the costs of installing solar panels, the desired percentage of energy from solar, the setbacks for the solar panel and the need to figure out the location where the solar panels will be placed. Town Chairman, Curt Peterson had indicated that he would work with the Town Patrolman to see where the lot lines are located to help determine where the panels could be placed. No action was taken.

14) Discussion & possible action re: TRIP/TRIP-D Projects. Clerk/Treasurer Sara Olson presented information in regards to the TRIP Township funding history that was received from Iowa County and indicated that there is a Iowa County Unit Meeting on Tuesday, October 10th in which there will be presentations in regards to new components to these programs.

15) Discussion & possible action re: Approval or Denial of Operator’s License for Kirsten Kligora. Kyle Levetzow made a motion to approve the operator’s license for Kirsten Kligora. Peter Vanderloo seconded the motion. Motion carried.

16) Discussion & possible action re: Iowa County Humane Society Contract - 2024. Clerk/Treasurer Sara Olson presented the 2024 Iowa County Humane Society Contract. David Pope made a motion to approve the 2024 contract with the modification that pre-approval must be received from the Town of Dodgeville prior to the intake of a stray cat under the 2024 contract. Kyle Levetzow seconded the motion. Motion carried.

17) Discussion & possible action re: Review of Insurance Policy (11-23 – 11-24). Clerk/Treasurer Sara Olson presented the Insurance Policy from Rural Insurance and the invoice in the amount of $15,966.00. The Town Board reviewed the insurance policy. Kyle Levetzow made a motion to approve and pay the invoice in the amount of $15,966.00. Peter Vanderloo seconded the motion. Motion carried.

18) Discussion & possible action re: Setting of Budget Meetings. The Town Board set a budget meeting on Monday, October 16th at 5:00 p.m. to work on the 2024 budget. The public budget hearing, special town meeting of the electors of the Town of Dodgeville and the Regular Town Board meeting will be held on Wednesday, November 8th at 6:00 p.m.

19) Adjournment. Kyle Levetzow made a motion to adjourn the meeting at 7:54 p.m. David Pope seconded the motion. Motion carried.
