Regular Town Board Meeting
October 6th, 2009 @ 6:00 p.m.
1) Call to order. Town Chairman, Curt Peterson called the meeting to order at 6:00 p.m.
Town Supervisors in attendance were: David Gollon, David Thomas, Charles Price and Thomas Mueller. Also in attendance were Clerk Sara Olson, Kathy Adams and Chess Adams.
2) Approval of Public Notice/Agenda. Supervisor, Thomas Mueller made a motion to approve the public notice and agenda seconded by Supervisor, Charles Price. Motion carried.
3) Approval of Meeting Minutes from September 1st, 2009. Thomas Mueller made a motion to approve the September 1st, 2009 minutes with the addition of putting the current owner’s name on the zoning petition and also inserting a total funds available category in the Treasurer’s Report for quick reference. David Gollon seconded the motion. Motion carried.
4) Approval of Treasurer’s Report for General, Sanitary District #1, 2, 3 and Tax Collection Account. Thomas Mueller made a motion to accept the Town of Dodgeville September 2009 Treasurer’s Report as submitted stating the following fund balances:
General Checking $ 20,264.09
Farmer’s Savings $ 7,468.93
M&I Bank Tax Account $ 50,390.22
Local Government Investment Pool $ 6,923.95
M&I Bank CD’s $ 100,000.00
Total Funds: $ 185,047.19
David Thomas seconded the motion. Motion carried.
Thomas Mueller made a motion to approve Sanitary Districts #1, 2, 3 Treasurer’s Report and Tax Collection Account as submitted stating the following fund balances:
Sanitary District #1 $ 15,008.64
Sanitary District #2 $ 8,516.52
Sanitary District #3 $ 273.90
David Thomas seconded the motion. Motion carried.
5) Bills to be approved. David Gollon made a motion to approve the October vouchers in the amount of $56,263.70. Thomas Mueller seconded the motion. Motion carried.
Curt Peterson made a motion to suspend the agenda. David Thomas seconded the motion. Motion carried.
6) Discussion & possible action re: Appeal of Driveway Variance for Chess Adams on James Road. Curt Peterson made a motion to re-discuss the Driveway Variance for Chess Adams on James Road due to new modifications had been made to the previous document that was presented to the Town Board. Thomas Mueller seconded the motion. Motion carried. Chess Adams presented a revised draft of a Driveway Agreement that contained previously requested requirements as well as additional requirements. David Gollon made a motion to approve the driveway variance with the following modifications to the Agreement:
#1 must state the following: First party will display a properly addressed fire sign to be placed at the James road access to the Adams property, and a second fire sign to be placed at the beginning of the West driveway originating from that access on the property presently owned by Jeff and Julie James.
#3 must state the following: First party will maintain that farm field driveway with:
- no grade greater than 10 degrees
- sufficient breaker run, as approved by the Town of Dodgeville Board Chair or Highway Supervisor, to assure safe passage of emergency vehicles that may be called to the log cabin for assistance
- minimum required turn-around space at the log cabin
- minimum required height and width clearance
A number 7 must be added stating the following: This driveway variance agreement is dependent upon the recording of a legal non-exclusive ingress-egress easement signed by present owners of traversed land (Jeff and Julie James). This easement is to be filed and recorded with the Iowa County Register of Deeds.
Thomas Mueller seconded the motion. Motion carried. Opposed were David Thomas & Charles Price.
7) Discussion & possible action re: 2009 Budget Review. Clerk/Treasurer Sara Olson presented the Town Board with an updated budget as of October 6th, 2009. The Town Board reviewed the budget. No action taken.
8) Discussion & possible action re: 2008 Audit Review. Clerk/Treasurer Sara Olson presented the Town Board with the 2008 Audited Financial Statements and Review from Johnson & Block. The Town Board discussed the Audit Review in detail. No action taken.
9) Discussion & possible action re: Plan Commission Recommendations. Thomas Mueller made a motion to recommend the approval of the rezoning of (2) 2.00 acres more or less parcels from A-1 Ag to AR-1 Ag Residential being in part of the SW/SW of S32-T7N-R4E, which is currently owned by Thomas & Annemarie Lalor with the conditions that 66.00 acres more or less are placed in the conservancy or overlay district, a shared driveway agreement is drafted and recorded as well as a shared well agreement. David Thomas seconded the motion. Motion carried.
Clerk/Treasurer Sara Olson presented the legal opinion from Mark Sewell at DeWitt, Ross & Stevens that was obtained as a result of a motion from the September Town Board meeting in reference to Development Right. No action was taken.
10) Discussion & possible action re: TRIP Program Road Projects. The Town Board discussed possible projects to be submitted under the TRIP Program for the year 2010. Thomas Mueller made a motion to submit the blacktopping of the hill on Esch Road which is approximately 4/10 of a mile and will cost approximately $60,000.00 for the TRIP Program in the year 2010 by the November 1st deadline. David Thomas seconded the motion. Motion carried. Thomas Mueller also made a motion to hire Keith Dalsing as the engineer to help complete the requirements and paperwork for the Brue Road TRIP-D Project. David Thomas seconded the motion. Motion carried. Charles Price was also re-appointed on the TRIP Committee at the County Unit Meeting.
11) Discussion & possible action re: 2010 Census New Construction Program. Clerk/Treasurer Sara Olson presented information from the U.S. Department of Commerce, U.S. Census Bureau in reference to a New Construction program. No action taken.
12) Discussion & possible action re: Hotel/Motel Tax. Town Board Supervisor, Charles Price presented information in reference to Hotel/Motel Tax to the Town Board. Charles Price stated that additional information will be presented to the local hotels/motels as well as the Town Boards in November. No action taken.
13) Discussion & possible action re: Iowa County Humane Society Vaccination Clinic. Clerk/Treasurer Sara Olson presented information to the Town Board in reference to conducting a Vaccination Clinic for the year 2010 held by the Iowa County Humane Society & Dodge-Point Mobile Pet Vet. David Thomas made a motion to authorize a Vaccination Clinic for the year 2010 that will be held at the Town of Dodgeville Hall. Thomas Mueller seconded the motion. Motion carried.
14) Discussion & possible action re: Setting dates & times for upcoming Budget Meetings. The next Special Town Board meeting to discuss the 2010 Budget will be held on October 12th, 2009 at 6:00 p.m.
15) Discussion re: Outstanding Building Permit Check #3858 from 2005 (Previous Clerk/Treasurer error). Clerk/Treasurer Sara Olson indicated to the Town Board that no payment was received by Nate Robinson to replace Check #3858 and the Certified Mailing that contained the demand for payment letter was never signed and returned to the Town of Dodgeville. Thomas Mueller made a motion that the Town Board seek legal action and proceed in filling a small claims case against Nate Robinson/Robinson Construction. Charles Price seconded the motion. Motion carried.
The Town Board didn’t go into Closed Session therefore no action was taken on Items #16, 17 and 18.
19) Public Comment. Clerk/Treasurer Sara Olson presented information in reference to the quote that was received for the electrical work needed to light the flagpole. No action taken.
20) Adjournment. David Gollon made a motion to adjourn the meeting at 8:56 p.m. David Thomas seconded the motion. Motion carried.
