Regular Town Board Meeting
September 1, 2009 @ 6:00 p.m.
1) Call to order. Town Chairman, Curt Peterson called the meeting to order at 6:00 p.m.
Town Supervisors in attendance were: David Gollon, David Thomas, Charles Price and Thomas Mueller. Also in attendance were Clerk Sara Olson, Betsy D’Angelo, Bob Butler, Greg Marr and Nate Robinson.
2) Approval of Public Notice/Agenda. Supervisor, David Gollon made a motion to approve the public notice and agenda seconded by Supervisor, Thomas Mueller. Motion carried.
David Gollon made a motion to suspend the agenda. Thomas Mueller seconded the motion. Motion carried.
3) Discussion & possible action re: Plan Commission Recommendations. David Gollon made a motion to recommend the approval of the rezoning of 4.85 acres more or less from A-1 Ag to AR-1 Ag Residential being in part of the SW/SW of S32-T7N-R4E which is currently owned by Gregory & Michelle Klusendorf. Thomas Mueller seconded the motion. Motion carried.
Thomas Mueller made a motion to seek a legal opinion in reference to the current language in the Comprehensive Plan to see if the Comprehensive Plan allows for the following: (1) Can an individual transfer their development rights to another individual? (2) What if the land is contiguous in another township beyond our jurisdiction? (3) Does the land have to be contiguous? Charles Price seconded the motion. Motion carried.
4) Discussion re: Outstanding Building Permit Check #3858 from 2005 (Previous Clerk/Treasurer error). Clerk/Treasurer Sara Olson presented the Town Board with information in reference to finding an original check that hadn’t been cashed from 2005 for building permits. Nate Robinson who was the contractor that wrote the original check also presented information to the board on why he felt he shouldn’t have to issue a new check to the Town of Dodgeville to replace the stale dated check that also had a stop payment placed on it. The Town Board felt that a new check needs to be issued by Nate Robinson to pay the outstanding building permits. Nate Robinson stated that he will not be re-issuing the Town of Dodgeville a new check at this time. No action was taken as the Town Board will convene into Closed Session according to Statue 19.85 (1) prior to making a decision on how they are going to handle the situation.
5) Discussion & possible action re: Mower Tractor & Equipment Repair Update. Clerk/Treasurer Sara Olson presented the Town Board with the status of the mower tractor & equipment repairs. David Thomas also distributed letters from Hennessey Implement in reference to the concerns the Town Board had with the last Ford tractor purchased from Hennessey Implement. The Town Board read the letter and Thomas Mueller stated that Bill Hennessey is a great person however it is water over the dam. No action taken.
6) Discussion & possible action re: Landscaping the area outside the Town Hall where the old tree was removed. Greg Marr presented the Town Board with a proposal for landscaping the area outside the Town Hall where the old tree was removed. This area would contain plants, a flagpole purchased by the Town of Dodgeville, an old grader donated by Curt & Donna Peterson, and a maple tree. Thomas Mueller made a motion to pursue with the landscaping as proposed using stone versus mulch, installing corrugated tubing for electrical to the flagpole, purchasing the flagpole, and leaving the installing of the maple tree until next spring. David Thomas seconded the motion. Motion carried.
7) Discussion & possible action re: Fall Clean-Up & Iowa County Recycling Event. Clerk/Treasurer Sara Olson reminded the Town Board about the upcoming events that were planned for the month of October and stated that postcards had been sent to Township residents detailing these events. No action taken.
8) Discussion re: New Farmland Preservation Update. Curt Peterson presented the Town Board with information in reference to Revisions to the New Farmland Preservation created under the recently passed state budget. For detailed information in reference to the changes please see the Town of Dodgeville Website at www.townofdodgeville.com. No action taken.
9) Approval of Meeting Minutes from August 4th, 2009. Thomas Mueller made a motion to approve the August 4th, 2009 minutes as submitted. David Gollon seconded the motion. Motion carried. David Thomas and Charles Price abstained from this motion as they were not present at this meeting.
10) Approval of Treasurer’s Report for General, Sanitary District #1, 2, 3 and Tax Collection Account. Thomas Mueller made a motion to accept the Town of Dodgeville August 2009 Treasurer’s Report as submitted stating the following fund balances:
General Checking $ 5,562.96
Farmer’s Savings $ 7,466.63
M&I Bank Tax Account $ 150,368.20
Local Government Investment Pool $ 6,920.00
M&I Bank CD’s $ 100,000.00
Total Funds: $ 270,317.79
Charles Price seconded the motion. Motion carried.
Thomas Mueller made a motion to approve Sanitary Districts #1, 2, 3 Treasurer’s Report and Tax Collection Account as submitted stating the following fund balances:
Sanitary District #1 $ 14,840.70
Sanitary District #2 $ 8,197.13
Sanitary District #3 $ 231.83
Charles Price seconded the motion. Motion carried.
11) Bills to be approved. David Gollon made a motion to approve the September vouchers in the amount of $102,484.63. David Thomas seconded the motion. Motion carried. Thomas Mueller abstained from this motion.
12) Discussion & possible action re: 2009 Budget Review. Clerk/Treasurer Sara Olson presented the Town Board with an updated budget as of September 1st, 2009. The Town Board reviewed the budget. No action taken.
13) Discussion & possible action re: Driveway Variance for Chess Adams on James Road. Chess Adams presented a draft of a Driveway Agreement that contained the items that were mentioned from the previous Town Board meeting. The Town Board discussed the agreement in detail. David Thomas made a motion to deny the driveway variance for Chess Adams based on the legal opinion from the town attorney as well as the precedence that such a variance will set. Thomas Mueller seconded the motion. Motion carried.
14) Discussion & possible adoption re: Resolution 2009-266 Bicycling Notification. Clerk/Treasurer Sara Olson presented the Town Board with Resolution 2009-266. Thomas Mueller made a motion to suspend the approval and adoption of this Resolution until next month to allow time for some modifications to be made to the Resolution. David Thomas seconded the motion. Motion carried.
15) Discussion re: Notification of the Bombay Bicyclist using township roads on September 6th. Clerk/Treasurer Sara Olson presented the Town Board with information in reference to the Bombay Bicyclist Club using township roads on September 6th for a bicycling event. No action taken.
16) Public Comment. Nate Robinson restated his opinion in reference to the outstanding building permit Check #3858 from 2005. Nate Robinson also stated that he would not be reissuing the check at this time and will be obtaining a legal opinion about the situation.
17) Closed Session in Accordance with Wisconsin Statue 19.85 (1) (g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which is or is likely to become involved. 18) Reconvene into Open Session. Thomas Mueller made a motion to reconvene into open session at 9:09 p.m. Charles Price seconded the motion. Motion carried.
19) Board Action as a Result of Closed Session. David Gollon made a motion to issue via certified mail a demand for payment letter giving Nate Robinson 30 days to respond. If payment or a response is not received within the 30 days the Town Board will meet again on this situation at the October 6th, 2009 meeting. Thomas Mueller seconded the motion. Motion carried.
20) Adjournment. Thomas Mueller made a motion to adjourn the meeting at 9:20 p.m. David Gollon seconded the motion. Motion carried.
