Plan Commission Meeting
Monday, September 28, 2009
The Town of Dodgeville Plan Commission met on Monday, September 28, 2009 at 6:30 PM. Chair, Dave Blume called the Planning Commission meeting to order at 6:30 PM.
Plan Commission Committee members in attendance were: Chair, Dave Blume, Laura Jean Blotz, Curt Peterson, John Crook, David Thomas, and Larry Lenox. Matthew Chitwood was absent.
Others in attendance were: Clerk/Treasurer Sara Olson, Debi Morton, Betsy D’Angelo, Joseph Meudt, Dawn Ingham, Thomas Lalor and Annemarie Lalor.
Chairman Blume verified that proper notice of the meeting was posted on September 15, 2009 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. Curt Peterson made a motion to approve the public notice and agenda. Larry Lenox seconded the motion. Motion carried.
Curt Peterson made a motion to approve the August 31, 2009 meeting minutes as submitted. Laura Jean Blotz seconded the motion. Motion carried.
Chairman Blume asked Thomas & Annmarie Lalor who was representing themselves in the current petition to explain the current petition. Thomas Lalor indicated to the Plan Commission that he was trying to rezone (2) 2.00 acres more or less from A-1 Ag to AR-1 Ag Residential for the purpose of separating 2.00 acres containing the main residence and garage, and 2.00 acres containing the other home and 2 machine sheds. The petition was to rezone (2) 2.00 acres more or less from A-1 Ag to AR-1 Ag Residential being in part of the NW/SE of S19-T6N-R4E in the Town of Dodgeville.
Curt Peterson made a motion to recommend the approval of the rezoning of (2) 2.00 acres more or less parcels from A-1 Ag to AR-1 Ag Residential being in part of the SW/SW of S32-T7N-R4E with the conditions that 66.00 acres more or less are placed in the conservancy or overlay district, a shared driveway agreement is drafted and recorded as well as a shared well agreement. John Crook seconded the motion. Motion carried.
Clerk/Treasurer Sara Olson presented the Planning Commission with the legal opinion from Dewitt, Ross & Stevens in reference to the current language in the Comprehensive Plan to see if the Comprehensive plan allows for the following: (1) Can an individual transfer their development rights to another individual? (2) What if the land is contiguous in another township beyond our jurisdiction? (3) Does the land have to be contiguous? Dewitt, Ross & Stevens indicated that the current Comprehensive Plan doesn’t allow transferring of development rights. The legal opinion can be reviewed and is on file at the Town of Dodgeville Office.
Plan Commission member Curt Peterson talked about the Farmland Preservation Law Update and the different options that were discussed at the Iowa County Planning meeting that was held in September.
Larry Lenox made a motion to postpone the discussion of establishing a Cluster Housing Ordinance for a 3 month time period. Laura Jean Blotz seconded the motion. Motion carried.
David Thomas made a motion to adjourn the meeting. John Crook seconded the motion. Motion carried.
